Terms and Conditions

These Terms & Conditions apply to services provided by Wellbeing Movement Therapy, including Clinical Pilates, Pilates, Yoga and Sports Massage sessions.

By booking or attending a session, you agree to these Terms & Conditions.

1. About Wellbeing Movement Therapy

Wellbeing Movement Therapy is an independent movement and wellbeing practice based in Godalming, Surrey.

Services may include:

  • Clinical Pilates

  • Private Pilates

  • Pilates apparatus sessions

  • Group Pilates classes

  • Yoga

  • Sports Massage

  • Workshops and other wellbeing services

Services are provided by Elena Fulton, unless otherwise stated.

2. Nature and scope of the services

Wellbeing Movement Therapy provides movement, exercise and massage services intended to support general wellbeing, physical confidence, strength, mobility, movement quality and recovery.

Clinical Pilates

Clinical Pilates sessions involve individually adapted Pilates-based exercise and movement.

Clinical Pilates is not physiotherapy, medical treatment or medical diagnosis and does not replace advice or treatment from a GP, physiotherapist, consultant or other appropriately qualified healthcare professional.

Where your circumstances indicate that medical or physiotherapy input may be appropriate, I may recommend that you seek advice or clearance from an appropriate healthcare professional before commencing or continuing sessions.

Sports Massage

Sports Massage is a hands-on soft-tissue therapy intended to support muscular wellbeing, recovery and movement.

Sports Massage does not diagnose medical conditions or replace medical diagnosis or treatment.

I will work within my professional training, qualifications and scope of practice. Where a condition appears outside my scope of practice, I may recommend that you seek advice from an appropriate healthcare professional.

3. Client responsibility and health information

You are responsible for providing accurate and relevant information about your health, injuries, medical conditions, medication, surgery, pregnancy or any other circumstances that may affect your ability to participate safely.

You should tell me if your health or circumstances change during the period in which you receive services.

You should not attend a session if you are unwell or if you have developed a condition that may make exercise or massage inappropriate.

If you are unsure whether a session is suitable for you, you should seek advice from your GP or another appropriately qualified healthcare professional before attending.

I may postpone, modify or decline a session if I reasonably believe that proceeding would not be appropriate or safe.

4. Consultation and informed consent

Before an initial Clinical Pilates or Sports Massage session, you may be asked to complete a consultation or health screening form.

The purpose of this information is to help me understand your needs, identify relevant precautions or contraindications and provide an appropriate service.

You will have the opportunity to ask questions before participating in a session.

For Sports Massage, you will be asked to provide informed consent before treatment begins.

You may withdraw consent or ask for a technique to stop at any time.

5. Individual suitability

Every client is different and no particular outcome can be guaranteed.

Results from Pilates, Clinical Pilates, Yoga or Sports Massage vary depending on factors including individual circumstances, consistency, previous injuries, health, lifestyle and other factors outside my control.

I will use reasonable care and professional judgement when adapting sessions to the information you provide.

6. Private sessions

Private sessions may include Clinical Pilates, Pilates, Yoga or Sports Massage.

Appointments are arranged directly with Wellbeing Movement Therapy.

Your appointment is reserved specifically for you, so please provide as much notice as possible if you need to change or cancel it.

7. Cancellation and rescheduling – private sessions and group classes

If you need to cancel or reschedule a private appointment or group classes, please provide at least 24 hours' notice wherever reasonably possible. Where less than 24 hours' notice is provided, or an appointment is missed without notice, I may charge the full session fee.

However, I will take reasonable circumstances into account, including genuine emergencies or unexpected illness.

Where I need to cancel or reschedule an appointment, I will provide as much notice as reasonably possible and offer an alternative appointment where available.

Nothing in this section affects any statutory rights you may have as a consumer.

8. Group classes

Group classes are subject to availability and are booked directly with Wellbeing Movement Therapy or through the relevant venue where applicable.

Class formats, locations, dates and times may change from time to time.

Please arrive in sufficient time to prepare for the class.

If you arrive late, I may need to modify your participation where necessary for your safety or the smooth running of the class.

9. Class passes and blocks

Where class passes or blocks are offered, the applicable price, number of sessions and validity period will be explained at the time of purchase.

Unless otherwise stated, unused sessions cannot be transferred to another person.

Where a class is cancelled by Wellbeing Movement Therapy, an appropriate alternative or replacement arrangement will be offered.

10. Class cancellations

If you are unable to attend a class, please provide as much notice as possible.

Where a class booking system or specific cancellation policy applies, the cancellation terms communicated at the time of booking will apply. I will take reasonable circumstances into account when dealing with late cancellations or missed classes.

11. Sports Massage appointments

Sports Massage appointments are subject to availability and must be arranged in advance.

Before treatment begins, you will be asked about relevant health information and any circumstances that may affect the suitability of treatment.

I may modify or decline treatment where I believe that:

  • Treatment may be inappropriate;

  • A contraindication is present;

  • The condition appears outside my professional scope;

  • Medical assessment or clearance would be more appropriate; or

  • Continuing treatment would not be in your best interests.

Where appropriate, I may recommend that you seek advice from your GP, physiotherapist or another suitably qualified healthcare professional.

12. Massage pressure and treatment preferences

Massage pressure and techniques will be discussed and adapted according to your preferences, needs and circumstances.

You should communicate with me during the treatment if:

  • Pressure is uncomfortable;

  • You experience pain;

  • You feel unwell;

  • You want a technique changed or stopped; or

  • You no longer wish to continue treatment.

You may stop a treatment at any time.

13. Payment

Payment arrangements will be confirmed at the time of booking.

Payment may be made by:

  • Bank transfer (BACS); or

  • Card payment using Zettle by PayPal.

Prices are communicated before or at the time of booking.

Where prices change, the new price will apply to future bookings and will not retrospectively alter an appointment that has already been confirmed at a different price, unless otherwise agreed.

14. Refunds

Where you have paid in advance and subsequently cancel a service, whether a refund is available will depend on the circumstances, the service booked, and any applicable cancellation terms.

Nothing in these Terms & Conditions is intended to remove or restrict any statutory consumer rights you may have.

Where I am unable to provide a service that you have paid for, I will offer an appropriate alternative, rescheduling option or refund where required or appropriate.

15. Gift vouchers and prepaid sessions

Where gift vouchers or prepaid sessions are offered, any applicable expiry date, restrictions or conditions will be communicated at the time of purchase.

Gift vouchers are not normally exchangeable for cash unless required by law.

16. Personal belongings

Clients are responsible for their personal belongings while attending sessions.

I cannot accept responsibility for loss or damage to personal property except where caused by my negligence or where liability cannot lawfully be excluded.

17. Clothing and preparation

For Pilates and Yoga, comfortable clothing that allows unrestricted movement is recommended.

For Sports Massage, you will be given appropriate information about clothing, draping and positioning before treatment.

Only the areas necessary for the treatment will be exposed, and appropriate professional draping will be used.

18. Professional boundaries and respectful behaviour

Wellbeing Movement Therapy is committed to providing a professional, respectful and inclusive environment.

Any inappropriate, threatening, abusive, discriminatory or sexually inappropriate behaviour will not be tolerated.

I reserve the right to end a session or decline future services where a client's behaviour is inappropriate or where continuing the professional relationship would not be reasonable or safe.

19. Children and young people

My services are primarily intended for adults.

Where a service is offered to anyone under 18, additional arrangements may apply, including appropriate parental or guardian involvement and consent.

Please contact me before making a booking for anyone under 18.

20. Pregnancy and postnatal clients

Pregnancy and the postnatal period may require appropriate modifications to exercise. I do not offer sports massage during pregnancy.

You should inform me if you are pregnant, recently gave birth or are experiencing pregnancy-related or postnatal health concerns.

Where appropriate, I may recommend seeking advice from your midwife, GP, obstetrician, physiotherapist or other healthcare professional before participating.

21. Working alongside healthcare professionals

Where appropriate and with your permission, I may work alongside information or recommendations provided by your GP, physiotherapist or other healthcare professional.

I will remain within my own professional qualifications and scope of practice and will not represent myself as providing physiotherapy, medical diagnosis or medical treatment.

22. Confidentiality and personal information

Information provided to Wellbeing Movement Therapy will be handled in accordance with my Privacy Policy.

Health information provided as part of a consultation may constitute special category personal data under UK data protection legislation and will be handled with appropriate safeguards.

23. Website information

Information published on the Wellbeing Movement Therapy website is provided for general information.

While I take reasonable care to keep information accurate and up to date, website information should not be treated as medical advice or as a substitute for professional healthcare advice.

24. Liability

I will provide services with reasonable care and skill.

Nothing in these Terms & Conditions excludes or limits liability where doing so would be unlawful.

In particular, nothing in these Terms & Conditions excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be excluded or limited.

Clients remain responsible for providing accurate health information and following reasonable instructions during sessions.

25. Complaints

If you have a concern about a service, please contact me as soon as reasonably possible so that I have an opportunity to understand and address the issue.

26. Changes to these Terms & Conditions

I may update these Terms & Conditions from time to time to reflect changes to my services, prices, business arrangements or legal requirements.

The latest version will be published on:

The Terms & Conditions applicable to a booking will normally be those in effect at the time the booking is made.

27. Governing law

These Terms & Conditions are governed by the laws of England and Wales.

Nothing in these Terms & Conditions affects any mandatory consumer rights that apply to you under UK law.
